The EMR increases the availability of documentation with which to defend or prove a malpractice claim. Health care providers face many risks for liability exposure on a daily basis, but many of those can be avoided. Knowing and understanding the potential risks is a health care providers best risk management strategy. This topic will present some new malpractice vulnerabilities associated with the EMR. If the EMR was revised at a time incongruous to the treatment, suspicion of falsification of the medical record may be alleged even in the absence of actual wrongdoing. Identifying potential exposures is key to limiting liability exposure of health care providers. A robust discussion based on real case scenarios will outline immediate and recommended actions steps to reduce liability exposure in today's contemporary health care environment.
