FMLA Issues Involving Medical Certifications

 

Learn how to comply with the FMLA's notice requirements and to get the most out of certifications of health care providers.

Since the FMLA became law in 1993, employers have struggled with how to manage FMLA leave appropriately. In the intervening years, the eligibility requirements have changed to add coverage for certain leaves related to military service, and to better define the role of joint employers in the FMLA context. With these changes, and the increased use of FMLA leave, employers have been challenged to comply with the FMLA's notice requirements, and its certification and recertification procedures. This topic will teach employers how to comply with the FMLA's notice requirements, and to get the most out of certifications of health care providers. The material also will provide an overview of privacy considerations affecting employers' access to employee medical information, and critical guidance on how to get value from the recertification process. Employers will learn how to avoid intermittent leave abuse, and use job descriptions proactively. Plus, the information will provide tips for preventing FMLA retaliation claims.
