Effects of Recent Events on Estate Planning

 

Explore the possible changes in tax law that could impact estate planning, and how to best advise clients during this time of uncertainty.

Recent events, including the 2020 election, may result in changes to tax laws that could be effective as soon as January. One major change may be the reduction of the current estate and gift tax exemption to less than half of its current amount. For clients with sufficient wealth, this may mean that making lifetime gifts now, before the law changes, could save a significant amount of eventual estate tax. For other clients, estate taxes may now become a concern, when they haven't been previously, requiring a revision to their estate planning documents. All clients, including those unlikely to be affected by the estate tax, still can benefit from having a solid estate plan in place, which may include trusts to protect assets from waste and creditor claims. This material will explore the possible changes in tax law that could impact estate planning, and how to best advise clients during this time of uncertainty. The information will also review the benefits of using trusts in estate planning in general, and sophisticated trust strategies that may be useful for high net worth clients, including those who have significant pension plans and IRAs.
