The requirement for discovery plans have existed in Rule 26(f) of the FRCP since the 1993 amendments, although discovery conferences have been part of Rule 26(f) since the 1980 amendments when 26(f) was first added. Frequently, courts and litigants simply decide to begin document production as quickly as possible for cost or schedule reasons. Such thinking is flawed, since it inevitably results in longer discovery periods and higher costs.
Studies have shown that when proper planning techniques are employed the overall cost of the effort is often cut by 50 percent or more when compared to similar efforts where rigorous planning was forsaken for perceived cost or schedule reasons.
