Construction Industry Defamation and Common Interest Privilege

 

Learn to navigate the complexities of defamation law in the construction industry.

Professionals in the construction industry are sometimes caught between a rock and a hard place when asked to provide owners or third parties with statements regarding the acceptability of others' design services or construction work. Failing to provide such statements could lead to the assumption of responsibility for those services and may even result in liability for breach of contract to the owner or other third parties. This program will examine common law and contractual duties that create reporting obligations for design and construction deficiencies to third parties. The primary focus will be on the common interest privilege--including circumstances in which this privilege has been applied, not applied, or lost through abuse. This program is essential for contractors, construction managers, subcontractors, architects, engineers, owner representatives, and others in the construction industry who may be required or asked to provide information about the design services or construction work of others.
