Whether we like it or not, digital evidence is everywhere. It is a product of the way that we live, work, and play in the 21st Century. Gone are the days where paper and other tangible materials are the exclusive form of evidence at trial. Digital evidence is simply the product of the modern, predominately digital environment in which we all increasingly operate. From emails, text messages, and social media to online banking and e-commerce, the digital revolution has transformed the manner, methods, and expense of both civil and criminal litigation. This broad-based overview on the use of digital evidence at trial in both the civil and criminal context in New Jersey is a necessary primer for all levels of litigators, from fresh out of law school to the most seasoned courtroom operator who may never have encountered the unique issues presented by operating with evidence captured from a virtual environment.
