Many social workers feel a sense of dread when they are asked by a parent or an attorney seeking support or testimony in what has become a high conflict marital dispute. The therapist may feel pressured to answer questions about what he or she believes is the child’s best interest and address the parent’s competency to parent. The request raises many questions about the therapist’s role as a fact or expert witness. There are worries about ethical traps, confidentiality, and anxiety about having to appear in court and subjected to cross examination.
