A Chapter 13 bankruptcy allows a debtor with a regular monthly income to discharge and reorganize debt through a payment plan. A creditor who ignores the process does so at their peril. This presentation is designed to explain the Chapter 13 bankruptcy process, including Chapter 13 plan treatment and the plan confirmation process. Attendees will also learn more about bankruptcy litigation, including relief from the automatic stay, proof of claim and claims litigation, 363 sales, and cramdowns. The program also provides best practices for unsecured and secured creditors as they navigate the bankruptcy process.
