Federal vs. State Causes of Action

 
The doctrine of sovereign immunity, which applies to state law claims against police officers, was imported wholesale from England and was based on the belief that the king was a divine being who could do no wrong. Thus, the long-held view in the United States has been that the government is immune from suit unless it waives such immunity. Over time, the Commonwealth of Virginia has chosen to waive such immunity under certain circumstances.
