Zoning Variances: Nonconforming Uses and Structures

Learn how to identify nonconforming use rights and understand how such rights may affect further use and development. Many existing uses of land are technically prohibited by zoning regulations, but are allowed to continue because they predate the zoning regulations prohibiting them. Such nonconforming uses are subject to heightened regulatory limitations that have important consequences for transferring property and obtaining development permits. This topic will help attorneys, and other professionals involved in real estate transactions and land use permitting, identify nonconforming use rights and understand how such rights may affect further use and development of property. This information is essential for those practicing in complex regulatory environments where land use regulations are prevalent and change frequently.
