Ethics in Environmental Law

Environmental consultants, engineers and attorneys are often faced with ethical dilemmas a) when helping clients address environmental contamination at properties during real property transactions, b) when helping clients respond to agency environmental enforcement actions, and c) when supporting clients in environmental litigation. In each of these scenarios, once sensitive environmental data gets into the hands of the consultant, engineer or attorney, they must immediately decide how to disseminate that information, if at all. Fortunately, the environmental industry has matured so that artful and ethically sound solutions have been devised to address many of these ethical dilemmas. This topic provides guidance to environmental consultants, engineers and attorneys on how to identify the most common ethical issues in environmental law. It then provides practice pointers to help minimize liability and preserve attorney/client privilege ethically and in an environmentally responsible manner.
