Witness Preparation - the Paralegal's Role

 
Paralegals can be very involved with the witness preparation. Starting early with the witness files is key. Fact witness files need to include key documents, discovery responses and deposition transcripts. Expert witness files need to include key publications/articles, deposition transcripts, CV and other key reports and documents. Providing the documents early for review can address any non-substantive issues.

Our speaker, Marlo Orlin Leach, reviews testimony and the topics covered during direct and cross-examination and the role of the paralegal. Gathering an outline of those topics and providing them to the witness to prepare. She also discusses the value of coddling the witnesses. The more material they have ahead of time the more prepared, relaxed, confident and happy they will be. Some witnesses will feel more comfortable with a walkthrough of the courthouse and courtroom prior to the trial. Conducting a mock examination is reviewed as well.
