Reverse Discrimination Claims and How to Avoid Them

The EEOC’s most recent statistics show an incredible increase in many categories of claims. One that is often overlooked is reverse-discrimination. As we see an increasing instance of clashing claims, for example, religion versus sexual orientation claims, employers need to navigate carefully between these clashing claims. This topic will review the reverse discrimination case law and then revisit some of the basics on how to conduct investigations and take effective remedial action under Title VII, especially with an eye toward resolving the clash of claims and avoiding reverse discrimination.
