The ADA, Addiction and Alcoholism: What an Employer Needs to Know

 
One of the most misunderstood and confounding problems impacting businesses today is managing drug and alcohol abuse within its workforce. The enactment of the Americans with Disabilities Act made the problem even more difficult for employers to manage. Moreover, recent amendments to the ADA bring the ADA’s protections to more people. See 42 USC § § 12101, et seq., as amended (2008). These materials discuss how the amendments impact management of those with addictions, and also attempt to provide some clarity to how such problems should be addressed. However, before attempting to apply its concepts to any fact pattern, it makes sense to know a little about the basics of the law.
