Legal Ethics of Multi-Jurisdictional Practices

Learn the process on how to properly sustain out-of-state lawyering while avoiding problematic situations.

House counsel, transactional lawyers, subject matter specialists, and attorneys with transient or multi-state clients are among the many lawyers that find they are providing legal services or offering legal advice outside their licensed jurisdiction(s). If your client is in multi-state ADR, or is defending an out-of-state lawsuit, or is purchasing foreign real estate, or has a security interest out-of-state, or enters a multi-state transaction, or is called away to testify, you may become embroiled in legal affairs beyond your license. If you are not admitted in the foreign jurisdiction, you may be engaged in the unauthorized practice of law, exposing yourself to criminal, as well as disciplinary, sanctions. This fast-paced topic will help you decide how to handle your out-of-state lawyering. You will learn to determine whether your activity constitutes the practice of law in a second jurisdiction, and if so, how to avoid problems. It may be advisable to appear pro hac vice, to substitute local counsel, or, perhaps, to become 'barred' in that state. Focusing on the ABA's Model Rule 5.5 (Unauthorized Practice of Law), we look at ways to avoid or handle some of the problems that arise when our practices cross state lines.
