A decent percentage of personal injury cases involve a person who was already compromised, i.e., had some sort of physical impairment or restriction that rendered them vulnerable to accident. This is prominent, for example, among the elderly and aging. When those persons have an accident or suffer an injury due to the physical condition of a place open to the public, there is a very good possibility that the Americans with Disabilities Act and Unruh Civil Rights Act can come into play. These 'hybrid' cases dramatically enhance the value of the case and create powerful leverage. This topic will discuss the nature of these hybrid cases, train practitioners how to spot the issues, will explore angles and traps for the unwary, and share relevant authorities and theories for maximizing recovery for clients.
