The Health Insurance Portability and Accountability Act (HIPAA) can be daunting to legal professionals who do not practice health care law regularly. Moreover, legal professionals may be covered or affected by HIPAA and not even know it. Since penalties for noncompliance are high and enforcement is on the rise, all legal professionals that handle health information need to understand when HIPAA applies and when it doesn't.
