Immigration Compliance in the Hospitality Industry

Worksite immigration enforcement continues to be a key priority for the Department of Homeland Security, ICE division under the Obama administration as well as for various states seeking to enforce recently-enacted state immigration laws in light of the U.

S. Supreme Court's decision in U.S. Chamber of Commerce v. Whiting. In FY 2010, ICE conducted over 2,200 audits and collected more than $50 million in fines. More than 25 states have passed their own immigration laws. With heightened enforcement at both the federal and state levels, employers must understand the basic rules of I-9 and E-Verify compliance as well as how to properly handle corrections on I-9 documents and set up an effective compliance program. Various resources are available to assist employers in maneuvering through the maze of immigration laws. While compliance is important, however, employers must be careful not to discriminate against applicants and employees in the process. It is also helpful for employers in the hospitality industry to understand the various visa and green card options available to employees. This OnDemand Webinar will provide a detailed review of worksite enforcement at the federal and state level including strategies to effectively manage the process, as well as an explanation of immigration visa strategies in the hospitality industry.
