Understand how the adoption and provisions of the Uniform Trust Code (UTC) affect trust administration in Arizona. This topic will deal with all of the common difficulties that a trustee and counsel will face and the solutions to those difficulties. You will learn how to properly transfer titles of assets to a trust, how to deal with assets that cannot or should not be transferred to a trust and how to correct mistakes that were never properly transferred to the trust. You will learn the procedures to pay trust creditors, and how to establish the valuation of assets, particularly of hard-to-value assets. There are many techniques to ascertain ambiguities in a trust's language that will be explored. Understand the unique nature of a trustee's duties and the undertaking of proactive measures to minimize trustee liabilities. This will include the preparation of trust reports and accountings.
