Every day HR professionals must navigate their way through fields filled with employment landmines. Leaves of absence are one of those fields that many find the most perplexing. When is a leave protected and for how long? How many times must we continue a leave? When does leave stop being an accommodation and starts being an undue hardship? This information will allow you to identify problematic traps in their policies and procedures and how to fix those problems. It will provide a framework to assess leave issues and forms to address them. It will also help employers develop strong ADA processes including requests for medical opinions and appropriate records. Lastly it will help evaluate when a leave, that is continually extended, becomes a hardship.
