Construction is one of the most hazardous industries and has the highest death rate among sectors regulated by OSHA. OSHA recognizes the fatal four types of hazardous activities, and these are performed by the employer’s own workers and often by workers who are employed by third-parties. When those contractors or temporary workers are killed, almost always there will be a wrongful death tort action that follows, brought by the family of the decedent. Others at the worksite may have claims for PTSD against the host employer. OSHA citations in such cases can be proof of negligence per se in some states that use comparative negligence doctrines. Exposure to toxic substances at the worksite, such as respirable crystalline silica, can also be a long term threat of litigation, as some illnesses have long latency periods. This course will discuss the wrongful death aspects of fatalities in the construction sector, and offer solutions for risk mitigation and best practices to avoid OSHA citations and wrongful death lawsuits.
