The California Consumer Privacy Act - What You Need to Know (Even if You're Not in California)

The California Consumer Privacy Act (CCPA) takes effect on January 1, 2020. It is the first comprehensive consumer privacy legislation in the United States. It has significant applicability outside of California. Despite the CCPA’s major significance, it is poorly drafted and difficult to understand, having been rushed through the California legislature in a mere seven days. The statute is a work in progress, with amendments to cure the worst problems still being finalized prior to the effective date. The regulations required by the CCPA have not yet been issued, so enforcement by the state of California will be delayed up to six months – but private rights of action are not delayed. Noncompliant companies can be sued starting on January 1, 2020. If your (or your client’s) company does business with customers in California, or collects online information from any California residents or households, you need to know whether the long reach of the CCPA extends as far as your company – and if so, how to comply so as to avoid penalties or private lawsuits.
