Collection Disputes: A Good Defense Is the Best Offense

July 24

Assess policies and procedures for compliance and identify areas of potential exposure to mitigate the risks of litigation and enforcement actions.

Credit and collection industry remains under an increased scrutiny from the regulators and a target of the aggressive consumer bar. In 2018, courts issued a number of seminal decisions with significant impact on the industry and, in particular, the use of technology in collections. This information is critical to understanding the hot-button issues facing the industry, including commonly brought claims under the Fair Debt Collection Practices Act, Telephone Consumer Protection Act, and Fair Credit Reporting Act. This topic will analyze potential strategies for defending against such claims brought on a class basis, and will help credit and collection professionals to assess their policies and procedures for compliance and identify areas of potential exposure. Gain valuable knowledge necessary to mitigate the risks of litigation and enforcement actions.

Learning Objectives

  • You will be able to explain strategies for defending consumer class actions.
  • You will be able to identify and analyze the risks and benefits of using various technology in collections.
  • You will be able to recognize how to tailor your policies and procedures to ensure compliance and address risks.
  • You will be able to discuss hot topics and recent developments in FDCPA, TCPA, and FCRA litigation and enforcement.
