Post-Judgement Attorney’s Fees Hearing

Preparing for the fee hearing will pay off in the long run.

While the Rules of Court do not block supplying testimony concerning the issue of entitlement and amount of attorney’s fees in the case-in-chief, over time the practice of the Court and Bar is to present the fact case and reserve jurisdiction to focus the issue of attorney’s fees at a later date.  The proceeding encompassing the determination of entitlement and amount of attorney’s fees is essentially a mini-trial. This white paper reviews why it is important to take the time to prepare for the presentation of evidence in the attorney’s fees hearing.
