California Statutory Collection Laws

 

Collections and community property laws include more than just what is owned by the debtor.

When a judgment is handed down, California law provides that the debtor’s property isn’t all that is subject to enforcement. The judgment extends to their spouse’s property as well. There may be additional costs and interest added to the judgment. As money comes in from the debtor those costs are paid first before being put against the balance of the judgment which exists for 10 years and can be renewed for an additional 10 years. However, there are other creditor remedies that can be used to satisfy the judgment as well.
