Implications of the Unlawful Internet Gambling Enforcement Act

 

Understand what risks confront gambling businesses operating on the internet.

The Unlawful Internet Gambling Enforcement Act was passed in 2006, but its implications are finally coming to light in 2022. The Act exemplifies the precarious balance between Federal and state rights. Congress could not outright ban gambling, so it has been left to the individual states to decide what, if any, gambling is legal within their territory. As a result, there is currently a morass around what is permitted and where. This course will explore the history of the UIGEA, its interplay with related federal statutes, such as the Federal Wiretap Law and the Professional and Amateur Sports Protection Act, its exceptions, enforcement, and types of gambling affected, from fantasy sports to online sports betting to online casinos and lotteries.
