The current administration has set forth guidance for the Department of Homeland Security and Department of Justice to begin intensifying efforts in investigating and punishing employers for immigration violations, including in the Employment Eligibility Verification space. At the same time, ensuring compliance with employment eligibility verification laws has become increasingly complex as technological tools like E-Verify evolve and laws and policies surrounding E-Verify shift. Employers face legal risks, operational challenges, and potential penalties if they fail to properly complete Form I-9s, misuse E-Verify, or respond inadequately to government audits and investigations. This presentation is designed to help navigate that landscape. We will begin with a foundational overview of the legal framework governing employment eligibility and the roles of Form I-9 and E-Verify. From there, we'll examine recent and forthcoming developments in E-Verify, including the rollout of E-Verify+ and remote verification protocols. We'll then move into a practical demonstration of how to use E-Verify effectively, highlight common pitfalls, and share key resources.
The presentation will address recurring compliance issues that attendees can search for in their own systems and practices. Finally, the presentation will provide an overview of government enforcement, offering guidance on how to prepare for and respond to audits or raids, including a walkthrough of internal audit procedures the presenter uses in his own practice.
