Phase I Site Assessment Standard; Material Changes to Meet Inquiries Requirements and Limit CERCLA Liability

Learn how conducting ESAs using the new ASTM E1527-13 standard will satisfy the requirements for all appropriate inquiries under CERCLA.

On Nov. 6, 2013, the American Society for Testing Materials (ASTM) published its updated environmental assessment standard (ESA) for Phase I environmental site assessments. The new standard, E1527-13, includes material changes from the old standard and provides clarity regarding the scope of an ESA.

This slide deck will explain how conducting ESAs using the new ASTM E1527-13 standard will satisfy the requirements for all appropriate inquiries under CERCLA. This will entitle the property owner to CERCLA liability protections, such as the bona fide prospective purchaser defense and innocent landowner liability protections.

For proper due diligence in identifying recognized environmental conditions on the property, counsel and their clients should conduct ESAs using the new ASTM E1527-13 standard. Counsel and their clients should also update all related due diligence policies and processes to reflect the new standard.
