Legal Causation and Disability in Workers' Compensation

When is an injury covered under workers' compensation?The value of a workers' compensation case very often hinges on whether a claim is accepted as compensable. The determination of whether to accept the compensability of the claim is one of the first decisions to be made on a case. Unless a claim is specifically accepted without prejudice, and is ultimately denied within the statutory time period, once a claim is accepted, the accepting party has owned liability for indemnity benefits and medical treatment. This topic will help those who are responsible for determining whether to accept or deny a claim to understand the legal components of a compensable injury. We will walk through each of the statutory elements of a compensable work place injury, and a compensable occupational disease.
