Understanding True Object in Sales Tax Analysis

January 19

Gain a better understanding of the true object test in sales tax analysis.

At one time, the true object test for applying sales or use tax to a transaction was encountered mostly by traditional service industries which sometimes transferred tangible personal property to their customers along with services. With the proliferation of hosted digital products and XaaS (X as a Service) product offerings, for which the nature of the product can be unclear, more tax professionals may need to become more acquainted with this very subjective test.

Learning Objectives

- You will be able to recognize when a true object analysis may be needed for determining if sales/use tax is applicable to a transaction.

- You will be able to review the various approaches states have taken to true object analysis.

- You will be able to explain application of the true object test in the context of a bundled transaction or mixed transaction.

- You will be able to identify the information and documents useful to the process of determining the true object of a transaction.
