Social Media Discovery: What All Attorneys Must Know

Be able to identify the main sources of social media evidence and ensure that it is properly preserved and requested in your case. Many civil litigators overlook that social media is a source of evidence, like any other ESI, that they may be required to preserve or otherwise consider in discovery activities in their case. Preservation obligations, aside, this topic will highlight the many ways that social media evidence can have a significant impact on the merits of civil litigation cases—you will be reminded about the ways in which you can use social media evidence, and, when needed, defend against it. This content helps attorneys understand first, where the obligation to consider social media evidence arises and next, why it may serve to benefit their case. Then, you will hear about considerations for preserving, collecting, and using social media. Finally, you will receive pointers on how to properly request (without legitimate objection) social media evidence and how to object to overly broad requests.
