Liabilities Associated with Pools, Spas and Fitness Facilities

The safe and cost effective operation of fitness facilities, including aquatic features and exercise rooms will be discussed, with foresight into trends and litigation.

A systems approach will be introduced and used to explore each component, from equipment specification through the biological contribution of patrons. When any piece of the "system" goes awry, dangerous conditions are created. Aquatics-related cases are one of the top two producers of significant jury awards and settlements in sports injury litigation. Lawsuits related to recreation have risen steadily during the past 30 years and are expected to continue to increase in the future. In 2005, the Seneca Lake Spray Park in Geneva, New York was the source of a cryptosporidium outbreak that infected hundreds of people and resulted in the requirement for advanced chemical treatment systems at spray parks. Suction entrapment prompted the first federal law directed at aquatic venues. As the aquatics industry continues to transition from conventional swimming pools to aquatic play features, understanding the complexities of these simple-looking systems will reduce operation and risk management costs.
