Creditor Compliance Rules: 3001C and 3002.1

Creditors and the attorneys who represent them need to be aware of these changes to avoid pitfalls that may negatively impact their ability to protect their interests in a bankruptcy case.

As part of the Forms Modernization Project the federal rules of bankruptcy procedure were amended in 2014-15 and new forms went into effect on December 1, 2015. These new rules and forms contain significant changes that impact creditor representation in bankruptcy cases, especially mortgage creditors, who are impacted by changes to Rules 3001(c) and 3002.1. Creditors and the attorneys who represent them need to be aware of these changes to avoid pitfalls that may negatively impact their ability to protect their interests in a bankruptcy case. This topic will help teach creditors and their attorneys how to navigate through these new rules and forms to ensure that they are in compliance with all of the new requirements. The topic will address each component of revised Rules 3001(c) and 3002.1 and will explain how to ensure conformity with these rules.

  • Has been a member of the Bankruptcy Bench Bar Committee for the District of Kansas, during which time she helped draft and update the local bankruptcy rules in the wake of BAPCPA
  • Was a member of the Ad-Hoc Advisory Committee for the United States Bankruptcy Court for the Western District of Missouri and is also a member of the following bar associations: The Kansas City Metropolitan Bar Association, the Association of Women Lawyers, the Kansas City Bankruptcy Bar Association, the Topeka Area Bankruptcy Counsel, the American Bankruptcy Institute, the National Association of Chapter 13 Trustees, the National Association of Bankruptcy Trustees, the International Women’s Insolvency and Restructuring Committee, the Turnaround Management Association and is chairperson for the Kansas City Women’s Bankruptcy Association
  • Prior to attending law school, Ms. Olsen spent 11 years at the Internal Revenue Service as an analyst
  • J.D. degree, with honors, University of Missouri Kansas City; B.A. degree, in English, Weber State University
