CERCLA Task Force Issues Recommendations

 

EPA Administrator Scott Pruitt has announced a set of Task Force recommendations that are aimed at improving the Superfund program.

The Agency’s adoption of these recommendations is another indication that demonstrable change to CERCLA implementation is of interest to the Trump administration. It follows the EPA Administrator’s May 9 retraction of certain remedy selection authority from regional offices. The 42 recommendations are contained in a report developed over the space of a month by a task force appointed by Administrator Pruitt.

Kaitlyn D. Shannon

Beveridge & Diamond Pc

Kaitlyn D. Shannon focuses her practice on environmental enforcement and litigation. She has experience with the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA); the National Environmental Policy Act (NEPA); and California’s Environmental Quality Act (CEQA) and routinely assists clients in navigating the interaction between state and federal laws in these areas. She also handles administrative appeals for employers under California’s Occupational Safety and Health (Cal/OSHA) program and has guided companies through the use of California writ petitions to challenge agency actions.

Kaitlyn also assists diverse industries in making strategic decisions before litigation is initiated to either resolve the conflict through early communications with the regulating agency or, if necessary, take action to preserve legal case theories. In particular, she provides advice to product manufacturers and trade associations under multiple California Extended Producer Responsibility (EPR) regulatory schemes.

Loren R. Dunn

Loren R. Dunn represents regional and national companies at locations throughout the country in environmental regulation and litigation issues.

Loren’s environmental projects have involved hazardous waste and large multi-party toxics cleanup sites, including marine and fresh water sediment sites, landfills, and natural resource damages claims. He has also conducted extensive work obtaining permits for key facility operations. He has particularly deep knowledge of the following industries: manufactured gas facilities, regulated utilities, smelters and metals refineries, pesticide sites, and large area contamination sites.

Before entering private practice, Loren worked for the U.S. Environmental Protection Agency headquarters office as a senior policy economist. He received an agency merit award for excellent work on the development of the Agency’s hazardous waste program and its regulations.

Loren has been repeatedly recognized as one of the leading environmental lawyers in the Northwest. He is a respected leader in handling complex environmental litigation, and remediation and restoration projects under CERCLA and state “little Superfund” statutes. He helped to pioneer the successful use of technical, large-group mediation to secure more efficient resolution and cleanup of large sites impaired by hazardous substance releases. He is co-chair of the ADR process of one the largest Superfund sites in the country located in the Pacific Northwest. He also has played a significant role in the development of Washington’s environmental regulatory system.

Loren was selected for inclusion in the 2004-2017 editions of Super Lawyers, and the 2007-2018 editions of The Best Lawyers in America©.
