The Beginnings of the Physical Presence Test

The key inquiry for the Internet vendor: does it have nexus with the destination state?

What’s involved in determining nexus? There is a buyer and a vendor. They are located in different states. The buyer places an order on the vendor’s website. The vendor accepts the order and delivers the goods. The vendor’s state is the origination state and buyer’s state is the destination state. This video reviews how to determine if the vendor have sufficient nexus in the destination state for sales/use tax collection; as well as discusses Quill v. North Dakota.
