How to Spend Your Time Before and During the Mediation Productively

 

Mediation day will be the cheapest day you ever have in the case.

This first big conceptual step in preparing for mediation is figuring out what you want. What’s in your client’s interest? That can include not just the technical subject matter of the mediation, but what the value is of getting this case resolved? Are there other creative solutions that might serve your interests? What about what the other side’s interests are? What are they wanting to see put on the table? This video reviews the mindset that your client needs to be in when starting mediation, the importance of timing, the value of finding out information of the mediator, and a review of the plaintiff and defense perspective.
