How to Determine FMLA Coverage and Eligibility

FMLA requires covered employers and eligible employees.

Currently the Family and Medical Leave Act provides up to 12 weeks of unpaid leave for eligible employees of covered employers, with benefit continuation, and reinstatement. Initially, FMLA leave was only available for employee’s own serious health condition, the serious health condition of family members, and the birth or adoption of a child, or care of foster child. This video reviews coverage under the FMLA and family leave expansion; as well as situations involving integrated and joint employers.
