HOAs, Condos and Developers in Representative States and Under Federal Law

Review suggested considerations for the association at transition.

Association responsibilities, powers and participants are usually set out in the declaration, but may also be in the articles and bylaws depending on state requirements. This can include rights of ownership and easements, membership voting rights, use restrictions, and limitations on partition and severance to name a few. The duty of the developer, at the time of transition, includes providing copies of all relevant documents to the association. Watch this video for additional details on these items and more suggested developer activities at transition.
