Details of the DOL Sex Discrimination Final Rule

Details of the Department of Labor’s final rule – Discrimination on the Basis of Sex - clarify regulatory protections for transgender employees. Because of sex includes gender identity and transgender status which is consistent with Executive Order 13672. Transgender employees must have access to the restroom designated for use by the gender with which they identify. The final rule removes the previous guidelines that referenced the need for separate or single-user restrooms to assure privacy between the sexes. Sex-specific, single-user restrooms are permissible and sex-neutral, single-user restrooms are a recommended best practice.

In this 8-minute video our speaker, Matthew J. Camardella, reviews details on the final rule in regards to pregnancy, childbirth and related medical conditions and provides examples of prohibited discrimination. Mr. Camardella discusses sex-based compensation discrimination under the final rule; as well as sex stereotyping discrimination.
