The most important part of construction contract drafting is to strike a fair and appropriate allocation of risk amongst the parties. Any risks that can’t be fairly allocated need to be addressed by insurance or surety bonds. The scope of work defines the work a party has agreed to perform under the contract, including work that the contractor will not perform.
