Inpatient vs. Observation Status: Medicare Law Update

 

Understand the difference between inpatient and observation status and the associated Medicare coverages to protect your clients.

Most seniors who are taken to the hospital often do not understand that if they are not told they have been admitted to the hospital, they are likely just being held for observation. In the event they require nursing home care, even rehabilitation, after their hospitalization, if they have only been kept at the hospital for observation, no matter the length of their stay, Medicare will not cover any of their nursing home stay, or any rehabilitation. Understanding this information will help you advise your clients and their advocates to identify the issues early on in a hospital stay to determine whether the patient is being held for observation or has been admitted. This topic also outlines changes under the Affordable Care Act and the NOTICE Act that impact the treatment of seniors in hospitals and have a significant effect on financing their stay at a nursing home after hospitalization. This information is critical for anyone who works with seniors and their advocates so they can ensure they know how to advocate on their behalf to have the individual admitted to a hospital to protect and preserve their eligibility to have Medicare defer some of the cost of rehabilitation or a short-term stay in a nursing home.
