There are new matters in regard to a guardianship, some of which are estate planning under a guardianship, houses that have a larger mortgage than the value of the house, and the new Ernie Banks elder abuse statute. There are new powers of attorney forms this year. In addition to powers of attorney, clients should include DNR’s and living wills, and when the powers should begin is important. Many clients need assistance in picking a nursing home, and the ethics involved with all of the above, and especially knowing who your client is, and whether your client has the capacity/competency to make decisions and execute documents, needs ethic review. Planning for other members of the family who are disabled or have special needs is another elder law consideration.
