Drafting and Administration of Wills for the Estate Planner

Get a thorough understanding of drafting and administering wills to ensure no mistakes or future will contests.

Many attorneys who are requested to prepare estate planning documents have to decide what kind of wills to draft and how to draft them without making mistakes. Executing these wills along with other related documents such as trusts or living wills or Powers of Attorneys is important. Some of the important matters which should be considered when preparing a will are how to disinherit a family member, having the will signed without elder abuse and reviewing the testator's capacity. This topic includes the persons responsible (attorneys) to understand the process for preparing wills from the initial conference with the client to the final execution of the documents. This involves the number and types of witnesses, the jurisdiction, and suggestions in how to make the whole signing safer and more efficient. Foreign testators shall be discussed and even the types of instruments to be used in signing and finally where to keep the document. Failing to properly sign a will can lead to mistakes and will contests.
