Commercial Vehicle Accident Cases

Truck accidents are inherently different than other roadway accidents. The focus of the litigation is often not the accident itself, but everything that led up to the accident. The ability to prosecute or defend a motor carrier following a significant loss is therefore directly related to the investigation undertaken, which ideally should begin immediately following the accident. This topic will provide a detailed account of the steps counsel will take to obtain the information needed to successfully represent their client - including when and how to conduct the investigations into the driver, the motor carrier and the trip itself. Our discussion will highlight the six key aspects of the Federal Motor Carrier Safety Regulations (FMCSRs) - which both the driver and carrier are required to follow - and will specifically discuss record keeping requirements, and the best use of experts to assist in gathering and evaluating the evidence obtained.
