IRS Form 1099 Reporting: What You Need To Know

There are many reasons why an employment relationship may be preferable to businesses over that of an independent contractor relationship. The primary reason employers prefer an employment relationship is one of control (both direct and indirect). Generally, the law assumes that a company will have more control over an employee than it will have over an individual with whom it independently contracts for services or products. The ability to exert more immediate control over someone’s work is often stronger if the individual is an employee. It may also be preferable to enter into an employment relationship, as opposed to an independent contractor relationship, with an individual because of hiring and recruiting advantages. Specifically, attracting and retaining qualified workers may be aided by their ability to access fringe benefits and other privileges of employment that are available exclusively to employees but that are not available to independent contractors.
